Terms of Service

1. Nature of Service

1.1. Estate Management Tool: Estastra is a Software-as-a-Service (SaaS) platform designed to assist residential estates in managing security, visitor access, and service charge records. We provide the technology infrastructure but do not manage the physical estate itself.

1.2. Not a Financial Institution: You acknowledge and agree that Jubiskra Limited is not a bank, wallet provider, or payment processor. We do not hold, transmit, or settle funds on your behalf. Our "Payments" features are strictly for record-keeping, reconciliation, and data tracking purposes only.

1.3. Estate Rules Apply: In addition to these Terms, you agree to follow the constitution, by-laws, and rules established by your specific Estate Management Association. Estastra is a tool to enforce those existing community rules.

2. User Accounts & Security

2.1. Eligibility: You must be at least 18 years of age to use the Platform.

2.2. Account Security: You are responsible for maintaining the confidentiality of your login credentials (username, password, and PINs). You agree to notify us immediately of any unauthorized access to your account.

2.3. Accurate Information: You agree to provide accurate, current, and complete information during registration. Jubiskra Limited is not liable for issues arising from incorrect contact details or house numbers provided by you.

3. Service Charge & Payment Logging

3.1. Direct Payments: All financial transactions (Service Charges, Levies) are made directly from the Resident to the Estate's designated bank accounts. Estastra does not process these funds.

3.2. Verification: Our system automates the verification of payments via email parsing and manual admin reconciliation. While we strive for 100% accuracy, it is your responsibility to retain proofs of payment in case of a dispute.

3.3. Access Control: You acknowledge that your Estate Management may configure the Platform to automatically restrict your access to the estate (e.g., gate entry) if your service charge records indicate an outstanding balance. Jubiskra Limited is not liable for any denial of access resulting from the enforcement of estate policies.

4. Visitor Management & Gate Access

4.1. Gate Passes: You are responsible for all Gate Passes generated under your account. You agree not to generate passes for unauthorized persons or for commercial purposes violating estate rules.

4.2. Security Checks: You consent to the recording of entry/exit timestamps for your vehicle and your visitors for security auditing purposes.

5. Acceptable Use

You agree not to:

• Use the Platform for any illegal purpose or to facilitate illegal activities.
• Attempt to gain unauthorized access to other users' accounts or the Platform's backend systems.
• Harass, abuse, or harm other residents or staff through the Community or Announcement features.
• Upload malicious code, viruses, or harmful data.

6. Limitation of Liability

6.1. "As Is" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted or error-free.

6.2. No Liability for Estate Actions: Jubiskra Limited is not liable for the actions, omissions, or policies of your Estate Management, including security lapses, maintenance failures, or disputes over funds.

6.3. Data & Connectivity: We are not responsible for losses or delays caused by the failure of your internet service provider, device malfunction, or third-party bank notification delays.

6.4. To the maximum extent permitted by Nigerian law, Jubiskra Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

7. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using Estastra, you consent to the collection and use of your information as detailed therein.

8. Termination

8.1. We reserve the right to suspend or terminate your access to the Platform if you violate these Terms or if your Estate's subscription to our service expires or is terminated.

8.2. You may stop using the service at any time by contacting your Estate Admin.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
